Donor Terms of Use

Effective Date: January 3, 2026

1. Acceptance of Terms

By submitting a gift card to Donate Your Balance ("DYB," "we," "us," or "our"), you agree to these Donor Terms of Use. If you do not agree, do not submit gift cards to DYB.

2. About DYB

DYB is a for-profit company, not a charity, nonprofit, or charitable solicitor.

DYB operates a gift card liquidation service. When you donate a gift card to DYB:

  • Ownership transfers to DYB upon submission
  • DYB liquidates the card through third-party resale and liquidation channels
  • DYB makes cash contributions to nonprofit organizations, including ones you may select from our partner list
  • DYB charges a service fee to cover processing, liquidation, and operational costs

DYB does not act as an agent of any nonprofit. DYB is not fundraising on behalf of nonprofits. DYB takes ownership of cards as its own inventory and makes independent contributions.

3. Eligibility

To donate a gift card to DYB, you must:

  • Be at least 18 years old (or the age of majority in your state)
  • Be a resident of the United States
  • Own the gift card and have full authority to donate it
  • Provide accurate information

4. Ownership Transfer and Donor Warranties

By submitting a gift card to DYB, you:

  1. Transfer full ownership of the gift card to DYB
  2. Represent and warrant that:
    • You own the gift card legally and have authority to donate it
    • The card was not stolen, obtained fraudulently, or purchased with stolen funds
    • The card has not been reported lost or stolen
    • The card is not subject to any disputes, claims, or legal holds
    • You have not previously sold, transferred, or donated the card to another party
    • All information you provide about the card (brand, balance, PIN) is accurate

Violation of these warranties may result in:

  • Criminal prosecution for fraud or theft
  • Civil liability for damages
  • Immediate termination of your ability to use DYB services

5. Gift Card Acceptance and Refusal

DYB reserves the right to:

  • Refuse any gift card for any reason without prior notice
  • Return cards that cannot be verified or liquidated
  • Request additional verification or documentation before accepting a card
  • Decline cards from certain retailers or with certain restrictions

If DYB declines your card:

  • DYB will attempt to return the card to you at the mailing address you provided
  • DYB is not responsible for lost or damaged cards during return shipping
  • DYB is not liable for any reduction in card value during the verification process

6. No Guarantee of Value or Timing

IMPORTANT: DYB does not guarantee any specific donation amount.

The cash value DYB receives from liquidating your gift card may be significantly less than its face value due to:

  • Processing fees charged by liquidation partners
  • Merchant restrictions or card terms and conditions
  • Expiration dates or inactivity fees
  • Market rates for specific retailers (some cards sell for as low as 50-70% of face value)
  • Partial balances or unusual denominations
  • Card verification issues

DYB does not guarantee processing timeframes. Liquidation and contribution timing varies based on:

  • Card verification requirements
  • Liquidation partner processing schedules
  • Nonprofit disbursement timelines
  • Volume of submissions

Processing may take several weeks or months.

7. Service Fee Transparency

DYB charges a service fee to cover:

  • Gift card verification and fraud prevention
  • Liquidation processing costs
  • Payment processing fees
  • Administrative and operational expenses

The service fee varies based on card brand, balance, and liquidation method. DYB retains the service fee before making contributions to nonprofits.

8. Tax Treatment for Donors

Donors should NOT expect a tax deduction for gift cards donated to DYB.

DYB is a for-profit company, not a 501(c)(3) nonprofit. Donations to DYB are not tax-deductible charitable contributions.

DYB does not issue tax receipts to donors. Any tax receipts issued are between DYB and the nonprofit recipient, not between DYB and the donor.

Consult your tax advisor if you have questions about the tax treatment of your gift card donation.

9. Prohibited Activities

You may NOT:

  • Submit gift cards you do not own or have authority to donate
  • Provide false, misleading, or inaccurate information
  • Submit stolen, fraudulent, or illegally obtained cards
  • Submit cards with zero balance or expired cards
  • Attempt to use a gift card after submitting it to DYB
  • Interfere with or disrupt DYB's services
  • Use DYB's services for any illegal purpose

10. Privacy and Data

Your personal information is governed by our Privacy Policy. By using DYB, you consent to our collection and use of your information as described.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

DYB SHALL NOT BE LIABLE FOR:

  • Any difference between gift card face value and actual liquidation value
  • Processing delays or failures
  • Cards declined or returned
  • Lost or damaged cards during shipping
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenues, data, or goodwill

DYB's total liability to you shall not exceed the face value of the gift card you submitted or $100, whichever is less.

12. No Warranties

DYB provides services "AS IS" without warranties of any kind. DYB disclaims all warranties, including:

  • Implied warranties of merchantability or fitness for a particular purpose
  • Accuracy of card valuations or processing timeframes
  • Uninterrupted or error-free service
  • Specific results or conversion values

13. Indemnification

You agree to indemnify and hold harmless DYB from any claims, damages, losses, or expenses (including attorneys' fees) arising from:

  • Your violation of these Terms
  • Gift cards you submit that are stolen, fraudulent, or submitted without proper authority
  • Any inaccurate or false information you provide
  • Your violation of any third party's rights

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Disputes shall be resolved as follows:

  1. Informal Negotiation: Contact us at support@donateyourbalance.com to attempt resolution
  2. Binding Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration
  3. Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions

15. Changes to Terms

DYB may modify these Terms at any time by posting updated Terms with a new Effective Date. Your continued use of DYB services after changes are posted constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
